Terms of Service

All clients are required to adhere to these terms. Violations may result in immediate account termination.

Overview

It is compulsory that you completely agree to these Terms of Service before signing up for a dusk.host account and subscribing to any of our services. By using or continuing to use any dusk.host service, you are automatically agreeing to the conditions of this document.

Acceptable Use

Clients must abide by our Acceptable Use Policy in order to use any of our services.

Account Registration and Service Activation

Once your order has been placed, your dusk.host account will be created immediately, allowing you access to our client portal which includes our billing and support panels. The setup of your service may require manual intervention as it is processed after payment has been received for potentially fraudulent activity.

Hosting Account Migration

We offer free migrations to all new customers. As this is a complimentary service, we cannot make any guarantees, although we strive to complete all migrations within 48 hours of the request.

Clients must keep in mind that the bottleneck of any account migration is the connection to your previous host and the speed of their support. dusk.host will begin your account transfer typically immediately after the proper login credentials have been provided and the dusk.host account has been setup.

dusk.host does not make any guarantees or take on any liability with potential issues that may arise. It is your responsibility to keep backups, stay involved in the migration, ask questions, and fully test the website or application before and after. If any issues are found we will work to resolve them under the best-faith effort policy. While we do exhaustive checks before and after the migration, it remains your responsibility to confirm everything has been migrated properly.

These free transfers are offered up to 30 days from the date your client account was registered. Past the initial 30 days, a variable transfer fee per hosting account (depending on your plan) may apply.

When transferring from a host that is not utilizing the same control panel as your dusk.host service, we may charge a variable fee per hosting account or per domain. The transfer fee will depend on what control panel and technologies your previous host is using.

Backups and Data Loss

Your use of our hosting services is at your sole risk. dusk.host is not responsible for the data residing on your account. You agree to take full responsibility for all data transferred and to maintain appropriate backups of your data hosted on our servers.

dusk.host offers automated backups on select services, however we accept no responsibility should backups be unavailable for any reason, including but not limited to, data corruption, hardware failure, or negligence.

Accounts larger than 50GB may be excluded from our automated backup system with or without notice, and at our sole discretion. Moreover, any account which is found to be in violation of our Terms of Service may, in addition to service suspension or termination, have all associated backups deleted.

All storage hosting accounts are excluded from our automated backup system.

Reseller Responsibility

All resellers are responsible for making sure their end users abide by our Terms of Service. Upon violation of any of our terms, dusk.host reserves the right to suspend either the end user account or the entire reseller account.

Support Scope and Limitations

All our clients are provided best-effort hardware, network, and server-level support on obtained services. Best-effort technical support is available 24 hours a day, 7 days a week, 365 days a year at no extra charge.

Software support (e.g., WordPress support, support for third party scripts and plugins, etc.) is not included in our web hosting plans. Clients who have obtained custom management and/or maintenance plans are provided a detailed scope of their specific management plan's inclusions and exclusions. Please contact us if you have any questions about this.

Payments

It is the client's responsibility to punctually settle their invoices at the beginning of each billing period.

When an invoice is delivered to the client, your payment must be sent to us no later than the specified payment due date. dusk.host shall be entitled to immediately terminate any and all of the client's services in case of failure to make timely payments.

Clients who fail to settle their invoices within 3 days from the due date will have their services tied to the invoice suspended. Furthermore, if an invoice is 7 days past the due date, a pre-determined late fee will be applied and the client would be required to settle the invoice, including the late fee, for their account to be reinstated.

Clients who fail to pay for their invoice 14 days after the original due date will have their hosting account permanently terminated, and all files will be deleted from our server. dusk.host shall not be responsible for providing data backups to clients with suspended or terminated accounts.

Service Cancellations and Payment Refunds

dusk.host reserves the right to cancel, suspend, or otherwise restrict access to any account at any time with or without notice.

dusk.host offers a 30-day money back guarantee. Clients who are not satisfied with our services may request a refund as long as they are within the 30-day money back guarantee period. After the initial 30 days, no refunds will be issued, whether in part or in full.

Only first-time accounts are eligible for our money back guarantee. If you've already had an account with us before, cancelled and signed up again, you will not be eligible for a refund.

Only your first order is eligible for our 30-day money back guarantee. If you have more than one service/product in your account and would like to avail of the money back guarantee, only your first order will be refunded.

Domain names and software licenses are non-refundable. If you received a domain and/or a software license as part of the hosting package you purchased and you wish to avail of our 30-day money back guarantee, the domain and/or license cost will be deducted from the refund amount.

Payment gateway fees are non-refundable.

Topped up account credits, deposited client account funds are not refundable.

All eligible clients who wish to take advantage of our money back guarantee must submit their refund request within the 30 day period. Refund requests must be sent through our ticket support system, and must be addressed to the Billing department. Refund requests made through other means will not be entertained.

Any overpayments made through automatic subscriptions will not be refunded. It is the client's responsibility to ensure that any payment subscriptions tied to cancelled services are terminated on their end.

Refunds will be issued only through the original payment gateway. For example, if a client paid through PayPal, their refund will be processed strictly via PayPal only.

Cryptocurrency payments are non-refundable. Orders paid with cryptocurrency are ineligible for any kind of refund, including our 30-day money back guarantee.

Clients who wish to cancel an active service must submit an official cancellation request at least two (2) business days before the service's renewal date. Clients who fail to submit a cancellation request in a timely manner will not be eligible for a refund should a service renewal transaction occur.

Clients who file transaction disputes and/or chargebacks will have all their dusk.host services terminated immediately. Moreover, all current and future refund requests will be denied, regardless of your client account status prior to the dispute/chargeback.

Abuse of our staff and/or attempts to damage dusk.host's public reputation in any medium or format will result in the suspension or termination of your services without refund.

Clients who violate any of our terms will automatically be ineligible for a refund.

Price Locks and Price Changes

dusk.host reserves the right to change the prices and plans listed throughout the dusk.host website in addition to the resources allocated to each of the dusk.host plans at its own discretion, with or without prior notice. We do not guarantee any price locks beyond your selected billing period, unless you specifically signed up for a service which is expressly tagged as "permanently price-locked." Furthermore, dusk.host has the right to end and/or refuse any promotional offers for any reason.

Refusal of Service

dusk.host reserves the right to refuse, cancel, suspend or terminate any client's service, at any time and at our sole discretion.

Disclaimer

dusk.host, under no circumstance, will be responsible for damages of any kind that your business may suffer. dusk.host makes no warranties of any kind, expressed or implied for services we provide other than the aforementioned guarantees mentioned within this document. dusk.host disclaims any warranty or merchantability or fitness for a particular purpose. This includes but is not limited to, loss of data resulting from delays, non-deliveries, hardware and software failures, acts of nature, hacking, sabotage, terrorist attacks, network issues, wrong delivery and any and all service interruptions caused by dusk.host staff and/or our upstream providers.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold dusk.host harmless from any and all demands, liabilities, losses, costs and claims, including any and all attorney fees asserted against dusk.host, including our staff and our customers, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the customer, its agents and/or employees. The customer agrees to defend, indemnify and hold harmless dusk.host against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with dusk.host; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from a dusk.host server.

Terms of Service Updates

dusk.host reserves the right to alter, revise, update and change the dusk.host Terms of Service (ToS) in any way without notice at any time under our sole discretion and can apply any and all changes and updates retroactively.
