dusk.host ("dusk.host", "our", "us" or "we") is a provider of cloud computing services. This means we either rent, own, and/or operate servers in datacenters to provide web hosting services ("Service" or "Services") to individuals and businesses. This Privacy Policy describes how we collect, use, and share information gathered from your ("you", "your", "Client", "Customer", "Direct Customer") use of our website, products and services.

Information We Collect

In order to provide you with a satisfactory level of service, dusk.host may collect any or all of the following information from you:

• Personal information which you may be asked to provide at the time of registration, including but not limited to: name, company name, address, telephone number, and email address.
• By linking our services to a third-party service, we may collect information from that account such as any authentication tokens involved in authorization.
• If you contact us via email or support ticket, we may collect data regarding your correspondence.
• We may collect details of your transactions involved in the fulfillment of orders. dusk.host does not store your financial information on our systems. Your financial information is stored with our third-party payment processors such as PayPal. dusk.host does, however, have access to, and may retain, your information through our third-party payment processors.
• Your IP address and browser user-agent are automatically logged by our system in order to allow us to help you diagnose any problems you may face when using our services.
• When visiting any of our website's pages, we may collect browsing information such as the time of and duration of visit, and time and duration of the pages on our website that you view. We may tie this information to personally identifiable information we have about you.
• When using our services, we may collection information about your utilization, such as processor, memory, storage, and network usage.

Use of Information

We will use your personally identifiable information only as follows:

• For transaction processing.
• To provide customer support.
• To provide, maintain, improve, and expand our services.
• To understand and analyze how you use our services.
• For fraud checking, reporting, and other screening methods involving third-party companies in order to verify information submitted to us.
• To enforce our Terms of Service, Acceptable Use Policy, and Service Level Agreement.
• To occasionally announce special offers or provide other information.
• To improve our services and the general marketing of our services. For example, we may use the information we gather from user surveys, demographic data, and website visits to help us improve or target our website and customize your visit.

If you register an account through an affiliate referral link, we may share information with your referrer to let them know that you used their referral to order service.

We may also place a "cookie" that will identify you to us as a repeat visitor or a customer when you visit our website. A cookie is an alphanumeric identifier that is unique to your browser. The cookie will identify your browser to us when you visit our website so that we may customize your visit.

We will not provide any personally identifiable information about you to any third-party other than:

• a law enforcement agency when requested via subpoena
• a potential business partner of any proposed mergers and/or acquisitions

End User Service Continuity

This clause applies to all dusk.host Direct Customers who are reselling dusk.host services in any way.

By using our services, the Direct Customer gives dusk.host full consent to be in communication with the Direct Customer's clients for end user service continuity purposes, provided that their end users' contact details are available on dusk.host servers and/or if the end users reach out to dusk.host, in the event that the Direct Customer fails to pay their invoice resulting in the suspension and/or termination of their account(s).

Fraud Protection

dusk.host uses a combination of Fraudlabs and FraudRecord to help deter any fraudulent activity. We screen new orders for previous fraud and general misbehavior. We also report existing clients who violate our Terms of Service. In case of a violation, we may report you to the anti-fraud services aforentioned with or without notice.

Protection of Personal Data

dusk.host employs a variety of security measures to protect personal data from unauthorized access. We give our best effort and employ best practices, however, you must recognize that no part of the internet can be considered 100% secure.

Data Retention

Your data will be retained and processed as long as it is required to comply with applicable legal, tax, or accounting requirements. At the end of the retention period, we will either delete or anonymize your data, unless it is stored in a backup archive and isolated from further processing.

Updating, Deleting, and Exporting Your Data

You may update your data at any time by logging in to the client area or by submitting a support ticket. We may require proof of identification in order to change certain data fields.

You may request that dusk.host export your personal data by opening a support ticket.

Customers with no active services may request that their account be closed and personal data be deleted from dusk.host's databases, with the exception of: billing system access logs, which may be stored for any duration of time at dusk.host's discretion, cases where financially fraudulent or otherwise illegal activity is deemed to have occurred (as determined by dusk.host management or law enforcement officials), in which case personal information may be retained indefinitely for purposes of ongoing investigation and prevention of fraud recurrence, or cases where a violation of the Terms of Service has resulted in termination of Customer's account, in which case personal information may be retained indefinitely for purposes of prevention of further use of dusk.host's services in the future by the offending Customer.

dusk.host will not delete any data required to comply with our legal obligations and financial requirements, or any data required to resolve disputes and enforce our legal agreements and policies.

Use of Non-Personally Identifiable Information

We may share aggregate statistical data about our customers with third parties, such as advertisers or upstream providers. This aggregate statistical data will not identify you personally.

Privacy Policy Updates

dusk.host retains the discretion to amend this privacy policy at any time, with or without notice. Clients are advised to check this page for updates from time to time. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become informed of any modifications made to this document.
